Acceptance of terms

By downloading, accessing, or using the Hourly News apps or the hourlynewsapp.com website, you agree to be bound by these Terms & Conditions. If you do not agree, do not use the service.

The service

Hourly News is an audio news application published by Urban Apps, LLC. The apps are available on iOS, macOS, watchOS, and CarPlay, and deliver short, regularly updated audio news from a range of sources.

License to use the app

We grant you a personal, non-exclusive, non-transferable, revocable license to use the Hourly News apps for your own personal, non-commercial use. Apps obtained through the App Store are also governed by Apple's standard Licensed Application End User License Agreement. Where those terms conflict with these for App Store distribution, Apple's agreement controls.

Subscriptions and auto-renewal

Some features require an auto-renewable subscription. The following terms apply:

• Payment is charged to your Apple Account at confirmation of purchase.
• The subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period.
• Your account is charged for renewal within 24 hours prior to the end of the current period, at the price of the selected plan.
• You can manage your subscriptions and turn off auto-renew in your App Store account settings after purchase.
• Prices may vary by region and are subject to change. Any unused portion of a free trial is forfeited when you purchase a subscription.

Billing is handled entirely by Apple — Urban Apps does not process or store your payment details.

Acceptable use

You agree not to reverse-engineer, decompile, tamper with, scrape, overload, or attempt to gain unauthorized access to the service, and not to use it to violate any law or to infringe the rights of others.

Third-party audio content

News audio and feeds originate from third-party sources and are provided on an "as available" basis. We do not guarantee their availability, accuracy, or timeliness, do not endorse third-party content, and are not responsible for it.

Intellectual property

The apps, the Hourly News name and logo, the website, and our original content are owned by Urban Apps, LLC and protected by applicable laws. No rights are granted to you except the limited license described above.

Disclaimer of warranties

The service is provided "as is" and "as available" without warranties of any kind, whether express or implied, to the maximum extent permitted by law.

Limitation of liability

To the maximum extent permitted by law, Urban Apps, LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service. Our aggregate liability is limited to the amount you paid for the app or subscription in the twelve months preceding the claim.

Termination

We may suspend or terminate your access to the service if you violate these terms. The license, intellectual property, disclaimer, and limitation-of-liability sections survive termination.

Governing law

These terms are governed by the laws of the State of New York, USA, without regard to its conflict-of-laws rules. Apple's Licensed Application End User License Agreement may impose its own governing-law terms for apps distributed through the App Store.

Changes to these terms

We may update these terms from time to time. When we do, we will change the "Last updated" date at the top of this page and post the new version at this URL. Continued use of the service after changes take effect constitutes acceptance of the updated terms.
